IN THE MATTER of an Appeal by MS K GREEN, a licensed trainer, assisted by Mr Westbury also a Licensed trainer who was permitted to act as advocate on Ms Green’s behalf against a decision of HRSA Stewards. Ms Green was charged with an offence of Rules HR190 (1), (2) and (4). The particulars of the charge being “Ms Green, as the trainer, presented GIFTEDFROMTHEHEART at Port Pirie in Race 5, Get Well Neville & Jenny Thomson Pace, 13 February 2024, where it raced and finished first, not free of a prohibited substance, cobalt.” Ms Green pleaded not guilty.
Rule HR 190 parts (1), (2) and (4) state -
(1) A horse shall be presented for a race free of prohibited substances.
(2) If a horse is presented for a race otherwise than in accordance with sub-rule (1) the trainer of the horse is guilty of an offence.
(4) An offence under sub-rule (2) or sub-rule (3) is committed regardless of the circumstances in which the prohibited substance came to be present in or on the horse.
