Harness Racing New South Wales (HRNSW) Stewards conducted an Inquiry yesterday into the failure by Licensed Trainer, Mr Joe Genesio to present the registered standardbred PENTAL CRACKER in accordance with the HRNSW Elevated TCO2 Policy at Bankstown on Friday 26 February 2016. PENTAL CRACKER was subsequently withdrawn from Race 3, the HENRY SCHEIN HALAS CUP (1740 metres) at Bankstown on that date.
PENTAL CRACKER was subjected to the HRNSW Elevated TCO2 Policy for 6 starts after a TCO2 level greater than 35 mmol/L was returned at Bankstown on 22 December 2015.
On 23 December 2015, Mr Genesio was directed to ensure that PENTAL CRACKER was presented on course in accordance with the following schedule;
a. At 10.00am on the date on which the horse is entered to run at a Metropolitan race meeting being conducted at Tabcorp Park Menangle.
b. No less than 4 hours prior to the scheduled start time in which the horse is entered at all other meetings.
Mr Genesio pleaded guilty to a charge issued pursuant to Australian Harness Racing Rule (AHRR) 238 which states:
AHRR 238. A person shall not fail to comply with any order, direction or requirement of the Controlling Body or the Stewards relating to harness racing or to the harness racing industry.
Mr Genesio was fined the amount of $1000 and was reminded of his right to appeal this decision.
In considering penalty Stewards were mindful of the nature of the offence, Mr Genesio’s licence history and other personal subjective factors including personal and financial hardship.
Harness Racing NSW (HRNSW) is the controlling body for harness racing in New South Wales with responsibility for commercial and regulatory management of the industry including 31 racing clubs across the State. HRNSW is headed by an industry-appointed Board of Directors and is independent of Government.
